中立帮助行为本身的“中立”特性使得其必须和刑法中的帮助行为所区分，
而不能因中立帮助行为人的行为主观上有间接故意及其行为与犯罪结果有因果联系就将行为人在刑法上评价为为帮助犯并进行处罚。太过机械地将社会中的一些与犯罪有偶然牵连的日常交往行为归为刑法中的帮助行为，会使得公民的行为自由受到过度限制。但是，全面否定中立帮助行为的可罚性又可能会导致法益保护的缺失，因此需要确立中立帮助行为可罚的标准。在本文中，笔者梳理了国内外专家学者对于中立帮助行为可罚性问题的学说和研究，并整理了国内立法及司法解释对中立帮助行为的处罚立场，为后续探讨提供法律依据和理论支撑；在最后重点分析中立帮助行为的归责标准并结合司法实践中常见的几种类型展开具体讨论。

Abstract
Neutral helping behavior itself characteristic of "neutral" makes it must be distinguished from the helping behavior in criminal law,we can't punish the person as an accessory just because his subjective indirect intention and his behavior is causally related to the crime result.Classifing some daily acts which associated accidentally with crime as helping behaviors in the criminal law,which will lead to excessive restrictions on citizens’ freedom of action.However, the total negation of the punishment of neutral helping behavior may lead to the lack of protection of legal interests. Therefore, it is necessary to establish the criteria for punishment to neutral helping behavior.In this paper, to provideI legal basis and theoretical support follow-up discussion ,I sort out the scholars’theory and research on the question of punishing neutral helping behaviors, and also the views on neutral helping behaviors in criminal law and judicial interpretation.In the final , I will focus on the analysis of criteria for punishing neutral helping behaviors and discuss specific types of common practices in judicial practice.
