我国《民法总则》采用大监护的立法模式，混淆了亲权与监护的关系，亲权制度与监护制度存在差异，以监护制度吸收亲权存在缺陷。为此，本文通过论述亲权与监护的内涵与性质，比较亲权与监护的立法原则及制度构建，研究我国民法典的学者建议稿，文末提出对我国民法典关于亲权与监护的立法建议。

ABSTRACT
"General Principles of Civil Law" in our country adopts ‘general guardianship ’system, which confuses the relationship between parental rights and guardianship. There are differences between the parental rights system and the guardianship system, and there are defects in the guardianship system's absorption of parental rights. Therefore, article discusses the connotation and nature of parental rights and guardianship, compares the legislative principles and system construction of parental rights and guardianship, and studies the proposed drafts of scholars of our civil code. At the end of the article, it proposes legislative proposals on parental rights and guardianship in our civil code. .
