摘  要
近几年来，随着公民权利意识的提高，各类新兴权利引起了民众的关注，其中隔代探望权的案件逐渐增多，关于隔代探望权的立法也被广泛讨论。新兴权利的出现给立法环节带来了一定的挑战，同时也为完善法制建设提供了帮助。
本文通过文献研究、规范阐释、案例分析三种方法对隔代探望权进行剖析，通过多方面阐述隔代探望权的规范必要性。
第一部分先介绍隔代探望权的定义，通过探望权引出隔代探望的含义，对二者进行初步比较；第二部分介绍为什么会出现隔代探望权的纠纷以及隔代探望权的价值和存在的意义，并分析受益群体；第三部分介绍我国隔代探望权的司法实践，以四个典型案例进行分析，说明其需要进行立法的原因；最后一部分阐述立法构想和制度完善建议。
全文通过四部分，对隔代探望权进行解释和分析，以证明其制度化改造的必要性。

Emerging Rights Research: A Case Study of Intergenerational Visiting Rights
Abstract
In recent years, with the increasing awareness of civil rights, all kinds of emerging rights have attracted the attention of the public, among which the cases of intergenerational visitation rights have gradually increased. Legislation on alternative generations of visitation rights has also been widely discussed. The emergence of emerging rights has brought certain challenges to the legislative process, and at the same time it will also help improve the construction of the legal system.
This article studies the intergenerational visitation rights through three methods: literature research, normative interpretation and case analysis, and elaborates the normative necessity of intergenerational visitation rights in many aspects.
The first part introduces the definition of intergenerational visitation rights, eliciting the meaning of the intergenerational visits through visitation rights, and conducts a preliminary comparison between the two; The second part describes why there are disputes about intergenerational visitation rights, and the value and significance of the intergenerational visitation rights, and analyze the beneficiary groups；The third part introduces the judicial practice of the intergenerational visitation rights in China and analyzes four typical cases and explains why it needs to be legislated；The last part elaborates the legislative conception and system improvement recommendations
The full text, through four parts, explains and analyzes the intergenerational visitation rights to prove the necessity of institutional transformation.
