摘  要：如今房地产行业是我国民生中最关键的问题，所以我们需要行政部门对房地产开发进行适时恰当的监管，使人们对房地产行业进一步的认识了解。本文先从房地产开发中的行政监管制度阐述了我国房地产开发中的各个利益关系以及房地产开发中的问题，也论证了房地产开发中行政监管的不足，以及得出了如何去完善房地产开发中的行政监管制度。

房地产开发是以开发土地和建造房屋为内容的一项营利性活动，它是一种商事行为。开发商通常是一个项目的总体策划、管理运作者。它通常会将项目分割成不同的子项目或工程外包给建筑商完成。一个完整的房地产开发通常包括土地开发和房屋的建设以及租售经营活动，但土地开发和房屋开发可能分开，分别由不同的人进行。它也是一项高风险的商业活动，因为它的投资周期长，市场波动大，所以既可能有巨额利润，也可能出现亏损。因此为了提高房地产开发投资的回报率和安全性，我们除了从投资经济学的角度做好项目评估、科学管理等工作外，还需要严格按照法律的规定来操作房地产开发的全程，减少或避免房地产开发的法律风险。尽管房地产开发是向社会提供商品谋取利益的行为，受一般的市场竞争规则和法律制度的调整。但是，由于房地产业的特殊性，国家对房地产开发实行了严格的行政管制。
